1. Acceptance of Terms

Welcome to Quizzer. These Terms of Service ("Terms") govern your access to and use of Quizzer's learning management system, including our website, mobile applications, and related services (collectively, the "Service"). By accessing or using Quizzer, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Service. If you are accessing Quizzer on behalf of a school, educational institution, or organization, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

Quizzer is an educational technology platform that provides:

• Online courses and educational content
• Interactive quizzes, exams, and assessments
• Flashcard creation and study tools
• Study rooms for collaborative learning
• Progress tracking and analytics
• Social features including friend connections and achievements
• Daily challenges and gamification elements

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts

3.1 Account Creation

To use certain features of Quizzer, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Types

Quizzer offers different account types including Student, Teacher, and Administrator accounts. Each account type has different permissions and access levels. You agree to use only the account type appropriate for your role and not to misrepresent your identity or qualifications.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent or harmful activities, or for any other reason at our sole discretion. You may also delete your account at any time through your account settings.

4. Acceptable Use

You agree to use Quizzer only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Impersonate any person or entity or misrepresent your affiliation
• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Attempt to gain unauthorized access to any part of the Service or other users' accounts
• Use automated systems (bots, scrapers) to access the Service without permission
• Interfere with or disrupt the Service or servers connected to the Service
• Share answers, cheat, or engage in academic dishonesty during exams or assessments
• Copy, reproduce, or distribute content from Quizzer without authorization
• Use the Service to transmit viruses, malware, or other harmful code
• Reverse engineer, decompile, or disassemble any part of the Service

5. User Content

5.1 Your Content

You retain ownership of any content you create, upload, or post on Quizzer ("User Content"), including questions, flashcards, notes, and comments. By submitting User Content, you grant Quizzer a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your User Content solely for the purpose of providing and improving the Service.

5.2 Content Standards

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to use and license your User Content
• Your User Content does not infringe on any third-party rights, including intellectual property, privacy, or publicity rights
• Your User Content complies with applicable laws and these Terms
• Your User Content is accurate and not misleading

5.3 Content Moderation

We reserve the right to review, edit, remove, or refuse to display any User Content that violates these Terms or is otherwise objectionable. We are not obligated to monitor User Content but may do so at our discretion.

6. Intellectual Property

The Service, including its original content, features, functionality, design, logos, and trademarks, is owned by Quizzer and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use our intellectual property without our prior written consent.

Quizzer respects the intellectual property rights of others. If you believe your copyright has been infringed, please contact us with details of the alleged infringement.

6.1 Prohibition of Unauthorized Use

STRICT PROHIBITION: All content, materials, questions, courses, educational resources, software, designs, logos, trademarks, and any other intellectual property available on or through Quizzer (collectively, "Quizzer Content") are the exclusive property of Quizzer and are protected by copyright, trademark, and other intellectual property laws.

You are strictly prohibited from copying, reproducing, distributing, displaying, modifying, creating derivative works from, selling, licensing, or otherwise using any Quizzer Content without our express written permission and a valid partnership or licensing agreement.

6.2 Unauthorized Use by Companies, Schools, and Institutions

IMPORTANT NOTICE TO COMPANIES, SCHOOLS, EDUCATIONAL INSTITUTIONS, AND OTHER ORGANIZATIONS:

If you are a company, school, educational institution, training organization, or any other entity (collectively, "Organizations"), you are expressly prohibited from:

• Using, copying, or distributing any Quizzer Content without a valid written partnership agreement or licensing agreement
• Incorporating Quizzer Content into your own educational materials, courses, or platforms
• Using Quizzer Content in your school's curriculum, training programs, or educational services
• Reproducing Quizzer questions, courses, or educational content for internal or external use
• Sharing Quizzer Content with students, employees, or other parties without authorization
• Using Quizzer's name, logo, or branding in connection with your services without permission
• Creating derivative works based on Quizzer Content
• Reverse engineering or attempting to extract Quizzer Content through automated means
• Using Quizzer Content for commercial purposes without a commercial license
• Claiming ownership or authorship of Quizzer Content

This prohibition applies regardless of whether:

• You have a Quizzer account or subscription
• You are using the content for educational purposes
• You are a non-profit organization or educational institution
• You claim to be unaware that such use requires permission
• You believe your use is "fair use" or falls under educational exceptions
• You are using the content internally within your organization
• You are not charging for the content

6.3 Required Authorization and Partnerships

To use Quizzer Content legally, Organizations must:

• Enter into a formal written partnership agreement with Quizzer
• Obtain a valid commercial or institutional licensing agreement
• Receive express written permission from Quizzer's authorized representatives
• Comply with all terms and conditions specified in such agreements
• Pay applicable licensing fees as determined by Quizzer
• Properly attribute Quizzer as the source of the content

No implied license exists. Merely accessing Quizzer or creating an account does not grant you, your organization, or any third party the right to use Quizzer Content. All rights not expressly granted are reserved by Quizzer.

6.4 Legal Action and Enforcement

QUIZZER WILL PURSUE LEGAL ACTION AGAINST UNAUTHORIZED USE:

Quizzer takes intellectual property protection seriously and will aggressively enforce its rights against any unauthorized use of Quizzer Content. If we discover that any company, school, educational institution, or other organization is using our content without authorization, we will:

• Immediately initiate legal proceedings against the infringing party, including but not limited to filing lawsuits in appropriate jurisdictions
• Seek monetary damages including actual damages, lost profits, statutory damages, and all legal costs and attorney fees
• Request injunctive relief to immediately stop the unauthorized use and prevent future infringement
• Pursue criminal charges where applicable under copyright and intellectual property laws, including Myanmar Copyright Law which provides for imprisonment of up to 3 years, or a fine of at least MMK 1,000,000, or both
• Report violations to relevant authorities, educational accreditation bodies, and professional organizations
• Seek punitive damages for willful infringement and bad faith use of our intellectual property
• Demand immediate cessation of all unauthorized use and destruction of infringing materials
• Publicly disclose the infringement and legal action taken, which may harm the reputation of the infringing organization

6.5 Monitoring and Detection

Quizzer employs advanced monitoring technologies and legal tools to detect unauthorized use of our content, including:

• Automated content scanning and plagiarism detection systems
• Digital watermarking and fingerprinting technologies
• Regular audits of educational platforms and institutional websites
• Legal monitoring services that track use of our intellectual property
• Cooperation with intellectual property enforcement agencies
• User reporting mechanisms for suspected infringement

We actively monitor the internet, educational platforms, and institutional websites for unauthorized use of Quizzer Content. Discovery of infringement may occur through automated systems, manual review, user reports, or legal investigations.

6.6 Consequences of Unauthorized Use

Organizations found to be using Quizzer Content without authorization will face severe consequences:

• Legal Liability: Full legal and financial responsibility for all damages, legal fees, and costs associated with the infringement
• Financial Penalties: Payment of substantial monetary damages, including actual damages and profits. Under Myanmar Copyright Law, violators may be subject to a fine of at least MMK 1,000,000 (one million Myanmar Kyat) in addition to other penalties
• Immediate Cessation: Required to immediately stop all unauthorized use and remove all infringing materials
• Account Termination: Permanent ban from Quizzer services for the organization and all associated individuals
• Reputational Damage: Public disclosure of the infringement, which may harm the organization's reputation and standing
• Loss of Accreditation: Potential reporting to educational accreditation bodies, which may impact institutional standing
• Future Restrictions: Permanent prohibition from entering into any partnership or licensing agreement with Quizzer
• Criminal Prosecution: Referral to law enforcement for criminal copyright infringement where applicable. Under Myanmar Copyright Law, unauthorized use of copyrighted content may result in imprisonment of up to 3 years, or a fine of at least MMK 1,000,000, or both

6.7 No Defense of Ignorance

Ignorance is not a defense. Claiming that you were unaware that Quizzer Content requires authorization, that you did not know it was copyrighted, or that you believed your use was permitted does not excuse unauthorized use. All users and organizations are responsible for ensuring they have proper authorization before using any Quizzer Content.

The fact that Quizzer Content is accessible through our platform does not constitute permission to use it elsewhere. The fact that you have a Quizzer account or subscription does not grant you rights to reproduce or distribute our content.

6.8 Reporting Unauthorized Use

If you become aware of unauthorized use of Quizzer Content by any company, school, or organization, please report it immediately to:

We investigate all reports of unauthorized use and take appropriate legal action. Reports may be made anonymously, though providing contact information may help us investigate more effectively.

Reward Program for Reporting Unauthorized Use

Quizzer offers a reward program to incentivize reporting of unauthorized use:

• If you report unauthorized use of Quizzer Content and we successfully win a court case against the infringing party, you may be eligible to receive 25% of the court winnings as a reward
• To be eligible for the reward, you must provide accurate, verifiable information that leads to successful legal action
• The reward is calculated as 25% of the total monetary damages, fines, and settlements awarded to Quizzer by the court
• You must provide valid contact information and be willing to cooperate with our legal team if needed (anonymous reports may not be eligible for rewards)
• Only the first person to report a specific unauthorized use will be eligible for the reward
• The reward will be paid within 90 days of Quizzer receiving the court-awarded damages
• Quizzer reserves the right to determine eligibility and the final reward amount at its sole discretion
• This reward program applies only to reports that result in successful legal action and monetary awards; cases that are settled out of court or result in non-monetary remedies may not qualify

By reporting unauthorized use, you help protect intellectual property rights and may be rewarded for your assistance. Report any suspected infringement immediately to be eligible for the reward program.

6.9 Acknowledgment

By accessing or using Quizzer, you acknowledge that:

• All Quizzer Content is protected by intellectual property laws
• Unauthorized use of Quizzer Content is illegal and will result in legal action
• You will not use Quizzer Content without proper authorization
• If you represent an organization, you will ensure your organization complies with these terms
• Quizzer will pursue all available legal remedies against unauthorized use
• You are responsible for any unauthorized use by you or your organization

If you are unsure whether your intended use requires authorization, contact us before proceeding. It is better to ask for permission than face legal consequences.

7. Academic Integrity

Quizzer is committed to promoting academic integrity. Users agree to:

• Complete exams and assessments honestly and independently
• Not share answers, use unauthorized materials, or engage in cheating during assessments
• Not create multiple accounts to gain unfair advantages
• Report suspected academic dishonesty to administrators

Violations of academic integrity may result in immediate account termination and may be reported to educational institutions.

8. Payments and Subscriptions

8.1 Premium Features

Quizzer offers both free and premium subscription plans. Premium features may include advanced analytics, additional storage, priority support, and exclusive content. Subscription fees are billed in advance on a recurring basis.

8.2 Payment Terms

By purchasing a subscription, you agree to pay all fees associated with your selected plan. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We reserve the right to change our pricing with 30 days' notice to existing subscribers.

8.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to premium features until the end of the paid period.

9. Account Sharing and Abuse Policy

9.1 Prohibition of Account Sharing

Your Quizzer account, including any premium or VIP subscription, is personal and non-transferable. You are strictly prohibited from sharing your account credentials, login information, or access to your account with any other person, including family members, friends, classmates, or colleagues. Each user must maintain their own individual account.

This prohibition applies to all account types, including free accounts, premium subscriptions, VIP memberships, and any other account tiers. Sharing accounts violates these Terms and constitutes a material breach of your agreement with Quizzer.

9.2 Detection and Monitoring

We actively monitor account activity to detect suspicious patterns that may indicate account sharing or unauthorized access, including but not limited to:

• Multiple simultaneous logins from different devices or locations
• Rapid switching between different devices or IP addresses
• Unusual access patterns inconsistent with normal usage
• Multiple users accessing the same account from geographically distant locations
• Inconsistent learning patterns or sudden changes in user behavior
• Excessive device registrations or frequent device changes
• VIP or premium account usage patterns suggesting shared access

Our monitoring systems use advanced analytics, device fingerprinting, IP tracking, and behavioral analysis to identify potential account sharing. We reserve the right to investigate any account activity that appears suspicious or violates these Terms.

9.3 Temporary Suspension and Investigation

If we suspect that your account is being shared or abused, we reserve the right to immediately and temporarily suspend your account pending investigation. During this suspension period:

• Your account access will be restricted
• You may be required to verify your identity
• We will review your account activity and usage patterns
• We may request additional information or documentation from you
• We will investigate the matter on a case-by-case basis

Suspension is not a determination of guilt but a protective measure to prevent further potential abuse while we conduct our investigation. We will make reasonable efforts to complete our investigation promptly and notify you of the outcome.

9.4 Consequences of Account Sharing

If our investigation confirms that you have shared your account or engaged in account abuse, we may take one or more of the following actions:

• Immediate Account Termination: Permanent termination of your account and all associated services
• Loss of Access: Immediate revocation of access to all Quizzer services, including premium features
• Data Deletion: Deletion of all account data, progress, achievements, and content
• IP Banning: Blocking of IP addresses associated with the abuse
• Device Blocking: Prevention of access from devices used in the abuse
• Legal Action: Pursuit of legal remedies where applicable

9.5 No Refund Policy for Account Abuse

IMPORTANT: If we determine that you have shared your account or engaged in any form of account abuse, including but not limited to sharing VIP or premium subscriptions, you will NOT be entitled to any refund, credit, or reimbursement of any fees paid, regardless of:

• The amount of time remaining on your subscription
• Whether the subscription was purchased recently or long ago
• Whether you were aware that account sharing violated these Terms
• Whether the account sharing was intentional or unintentional
• The amount of money you have invested in your account
• Any unused portion of your subscription period

This no-refund policy applies to all subscription types, including monthly subscriptions, annual subscriptions, VIP memberships, premium plans, and any other paid services. By purchasing a subscription, you acknowledge and agree that account sharing constitutes a material breach of these Terms and forfeits any right to refunds.

We reserve the right to retain all fees paid, regardless of when the abuse is discovered, whether during an active subscription period or after cancellation. This policy is necessary to protect the integrity of our platform and prevent abuse of our services.

9.6 VIP and Premium Account Abuse

VIP and premium accounts are subject to enhanced monitoring due to their elevated privileges. Any suspected sharing of VIP or premium accounts will be investigated with particular scrutiny. If we detect that a VIP or premium account is being shared:

• The account will be immediately suspended pending investigation
• All premium features will be disabled during the investigation
• If abuse is confirmed, the account will be permanently terminated
• No refund will be provided for any remaining subscription period
• All associated accounts may be subject to review and potential termination

Purchasing a VIP or premium subscription does not grant you the right to share access with others. Each individual user must purchase their own subscription to access premium features.

9.7 Legitimate Multi-Device Usage

We understand that legitimate users may access their accounts from multiple devices (e.g., a laptop, tablet, and smartphone). Normal multi-device usage by a single individual is permitted and will not trigger our abuse detection systems. However, simultaneous access from multiple devices in different locations, or patterns suggesting multiple users, may be flagged for review.

If you believe your account has been incorrectly flagged, you may contact our support team to explain your usage patterns. We will review legitimate cases on an individual basis.

9.8 Your Responsibility

You are solely responsible for maintaining the security and confidentiality of your account credentials. You must:

• Never share your username, password, or account access with anyone
• Use strong, unique passwords for your account
• Enable two-factor authentication if available
• Log out from shared or public devices
• Report any suspected unauthorized access immediately
• Ensure that only you access your account

If you suspect that your account has been compromised or accessed without your authorization, you must immediately notify us and change your password. However, you remain responsible for all activity on your account, including activity that occurs before you notify us of unauthorized access.

9.9 Acknowledgment

By using Quizzer, creating an account, or purchasing any subscription, you acknowledge that you have read, understood, and agree to be bound by this Account Sharing and Abuse Policy. You understand that account sharing is strictly prohibited and that violation of this policy will result in account termination without refund.

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. QUIZZER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. We are not responsible for any content, accuracy, or opinions expressed in User Content or third-party materials.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIZZER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Quizzer, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another party.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of Quizzer after such changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Myanmar (Republic of the Union of Myanmar), without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction in Myanmar.

Myanmar Copyright Law: Unauthorized use, reproduction, distribution, or infringement of Quizzer Content is subject to criminal prosecution under Myanmar Copyright Law. Violators may face imprisonment of up to 3 years, or a fine of at least MMK 1,000,000 (one million Myanmar Kyat), or both, in addition to civil liability for damages and other remedies available under law.
